研制无线电发射设备的管理规定(附英文)

第一条 为加强对无线电发射设备的研制管理,根据《中华人民共和国无线电管理条例》制定本规定。
第二条 凡在中华人民共和国境内研制(含试制,下同)无线电发射设备的单位必须遵守本规定。
第三条 在本规定中,无线电发射设备定义为:无线电通信、导航、定位、测向、雷达、遥控、遥测、广播、电视等各种发射无线电波的设备,不包含可辐射电磁波的工业、科研、医疗设备、电气化运输系统、高压电力线及其他电器装置等。
第四条 研制无线电发射设备必须符合国家有关技术标准和无线电管理有关规定。
第五条 研制无线电发射设备必须按以下程序办理核准手续:
(一)研制单位必须提交研制申请表(见附件1)、研制单位主管部门批准文件、可行性报告及技术资料等相关文件。中央国家机关及其在京直属单位向国家无线电管理委员会办公室(以下简称国家无委办公室)领取和提交申请表,其他单位向所在省、自治区、直辖市无线电管理委员会办公室(以下简称省、区、市无委办公室)领取和提交申请表,经省、区、市无委办公室提出意见后转报国家无委办公室。
(二)国家无委办公室对申请表和相关文件进行审查。审查合格后,由国家无委办公室核发无线电发射设备研制核准批件(见附件2),并抄送相关省、区、市无委办公室。
第六条 国家无委办公室和相关省、区、市无委办公室对批准的研制项目进行监督和检查。研制单位在规定时间内未能完成研制任务,必须向国家无委办公室提出申请办理延期手续,否则,国家无委办公室核发的研制核准批件自动失效。
第七条 研制无线电发射设备时,如需进行实效发射,必须按设置无线电台有关管理规定办理临时设台手续。
第八条 研制完成后,应由相关科技管理机构根据国家科学技术委员会发布的科学技术成果鉴定办法或其它有关规定组织技术鉴定,该研制设备的技术指标应符合国家无委办公室核发的无线电发射设备研制核准批件的要求,其鉴定的文件、资料应报国家无委办公室和所在省、区、市无委办公室备案。
第九条 研制专供军事系统使用的无线电发射设备,按国家和中国人民解放军无线电管理委员会的有关规定办理。
第十条 违反本规定研制无线电发射设备,按国家无线电管理有关规定给予处罚。
第十一条 本规定由国家无线电管理委员会办公室负责解释。
第十二条 本规定自发布之日起施行。

Provisions on the Development of Radio Transmission Equipment
Article 1
In order to strengthen the management on the development of radio
transmission equipment, provisions are established in line with "the Radio
Regulations of the People's Republic of China."
Article 2
Any unit which engages in the development (hereinafter including trial
production) of radio transmission equipment must follow the provisions.
Article 3
In these provisions, a radio transmission equipment is defined as any
equipment which radiates radio wave for communication, navigation,
location, determination, direction finding, remote control, telemetry,
broadcasting, TV transmission and radar purposes. It does not include any
equipment which transmits electromagnetic wave for the industrial,
scientific and medical use, electrical transportation system, high voltage
power carrier and other electrical devices.
Article 4
The development and manufacture of radio transmission equipment must
comply with the technical standards of the state and the radio regulations
concerned.
Article 5
Approval should be obtained according to the following procedure before
radio transmission equipment is developed.
a). The unit concerned should submit related documents such as the
application form (see annex 1), approval document from the authority
concerned, feasibility report and technical materials. central government
institutions and their affiliated units in Beijing receive and submit
application forms from and to the Office of State Radio Regulatory
Commission (hereinafter referred to as SRRC Office). Other units get and
submit application forms from and to the Office of Radio Regulatory
Commission in various provinces, autonomous regions and
municipalities (hereinafter referred to as Local RRC Office). These
applications will be transferred to the SRRC Office with the opinions of the
Local RRC Office of various provinces, autonomous regions and
municipalities.
b). The application form and other related documents will be reviewed
by the SRRC Office. For those units which are qualified, SRRC Office will
issue the approval (see Annex 2) with copies sent to the Local RRC Office
concerned.
Article 6
SRRC Office and Local RRC Office concerned conduct monitoring and
supervision over the approved projects. If any unit fails to complete the
development within the specified period, it must apply for the extension of
the approval from the SRRC Office. Otherwise, the approval becomes
invalid in due time.
Article 7
During the development of the radio transmission equipment, the unit must
go through the procedure necessary for a temporary station in accordance
with the provisions in regard of setting up radio stations when actual
transmission is required.
Article 8
Upon the completion of development, appraisal should be organized by the
scientific and technological administrative organs according to the Appraisal
Method on the Scientific and Technological Achievements issued by the
State Commission of Science and Technology. The technical objectives
should comply with the requirement put forward by SRRC Office on radio
transmission equipment. Appraisal document and material should be put on
the file of SRRC Office and Local RRC Office concerned.
Article 9
The development of the radio transmission equipment for military use
should follow the provisions of both SRRC Office and the Radio Regulatory
Commission of the People's Liberation Army of China.
Article 10
Any unit which develops radio transmission equipment violating these
provisions will be punished according to the state radio regulation
provisions.
Article 11
SRRC Office is responsible for the interpretation of these provisions.
Article 12
These provisions start to be implemented form the day they are issued.
